Terms of service
These terms are an agreement between you and the operator of Clmify. Please read them before you create an account or pay for a plan.
1. Who we are
Clmify (the Service) is operated by [seller's full legal name], a private individual and sole trader residing in [country] (we, us). You can reach us at [support email].
Clmify is not affiliated with or endorsed by Discord Inc. Discord is a trademark of Discord Inc.
2. What the Service does
The Service is a username availability checker and monitor. It checks whether Discord usernames are free, scans sets of names on our servers, watches names you choose and alerts you when a name frees up.
- A result shows the status of a name at the moment of the check. A name that was free a minute ago may be taken now.
- We do not guarantee that you will be able to claim a name in Discord. Discord may refuse a name even when it follows the published rules.
- We never claim names for you and never ask for your Discord password or token. You claim names yourself in Discord.
3. Who can use the Service
You must be at least 16 years old. If you are under the age of majority where you live, a parent or guardian must accept these terms for you and make any payments.
By creating an account or using the Service, you accept these terms, the Acceptable use policy, the Refund policy and the Privacy policy.
4. Your account
- Give a working email address and keep your password safe. You are responsible for everything done with your account.
- One person, one account. Creating several Free accounts to get more checks is not allowed.
- You can turn on two-factor sign-in in settings. When you sign in with Discord or Google, the two-factor protection of that provider applies.
- You can delete your account at any time in settings. Section 13 explains what happens then.
5. Plans and checks
Checks. A check is one clear answer from Discord about one name: free or taken. Answers served from our cache and unclear answers are not charged.
Plans. The Free plan includes 500 checks a month. Paid plans (Starter, Pro and Max) include more checks, more threads, a larger watchlist and personal drops. The current limits and prices are on the pricing page. Without an account you can make 5 checks a day on the home page.
Monthly checks. Checks included in a plan are granted every month on your renewal day, also on yearly plans. Unused monthly checks do not carry over.
Check packs. Packs are one-time purchases. Their checks never expire and are used after your monthly checks run out. Packs cannot be transferred to another account or exchanged for money, except under the Refund policy.
When checks run out. Scans and the watchlist pause and continue by themselves after you buy a pack or your monthly checks renew.
Changes. We may change plans, limits and prices. A new price applies to your subscription only from your next renewal, and we tell you by email before that.
6. Payments
All prices are in US dollars. Taxes such as VAT may be added at checkout depending on your country.
Card payments. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all card orders. Paddle provides customer service for payment questions and handles returns for card orders. Card subscriptions renew automatically at the end of each period until you cancel them. You can cancel at any time in your dashboard; the plan stays active until the end of the paid period.
Crypto payments. Crypto payments are processed by CryptoCloud. A crypto payment covers one period of 1 or 12 months and does not renew automatically. We remind you 3 days and 1 day before the period ends.
Where card payment is available. Paddle does not accept buyers from some countries, including Russia and Belarus. In those countries new purchases are possible only with crypto.
Upgrades take effect right away. You pay the difference for the rest of the period and receive extra checks in proportion to the time left until your next renewal day. Downgrades and switching between monthly and yearly billing take effect at the end of the current period.
Failed card payments. If a renewal payment fails, your limits stay as they are, but new monthly checks are not granted until the payment goes through. If it does not go through after Paddle's retries, the subscription ends.
When a paid plan ends, your account moves to the Free plan. Remaining monthly checks lapse, checks from packs stay. Scans over the Free limit pause, and watchlist names over the limit pause; nothing is deleted.
7. Refunds
Refunds follow the Refund policy. In short: within 7 days of payment, if you used less than 10% of the checks granted for that period and received no personal drops in it, once per account.
8. Personal drops and the public feed
Our background scanner looks for free names. When it finds one, it may offer it to one paid user as a personal drop.
- For 15 minutes we offer a personal drop to nobody else and keep it out of the public feed. This is an exclusive offer from us, not a guarantee that nobody else finds the name in that time on their own.
- Drops are available on paid plans while the subscription is active or canceled but not yet ended. Each plan has a daily drop limit. You do not receive drops in a period you were refunded for.
- Names that were not claimed may appear in the public feed later. A name in the feed may already be taken.
- We do not offer or publish names of well-known people and brands.
Names you check or find yourself are private. We never publish them or offer them to other users.
9. Availability
We work to keep the Service running, but we do not guarantee uninterrupted operation. Discord may change how usernames work or limit the checks the Service relies on at any time. In that case the Service may slow down or stop, and we will tell you.
If the Service cannot run checks for a long time because of a problem on our side, we compensate affected paid users with extra checks. We do not extend the paid period or refund money for downtime.
10. Your use of Discord
You are responsible for following Discord's Terms of Service and Community Guidelines when you claim and use a name. Checking a name with the Service does not use or touch your Discord account.
11. Your data and content
You keep the rights to the lists and names you upload. You allow us to process them only to provide the Service. We keep a shared cache of name statuses (name, status, time of check) that is not linked to who made the check. How we handle personal data is described in the Privacy policy.
12. Our rights
The Service, its design, code and texts belong to us. You may not copy, resell or resell access to the Service. The Acceptable use policy lists what else is not allowed.
13. Suspension, blocking and account deletion
We may pause or block an account that breaks these terms or the Acceptable use policy. We usually warn first, unless the breach is serious or the law requires us to act at once.
If you open a chargeback, your account is blocked, your balance is set to zero and your subscription is canceled. Please contact us first: most payment problems are solved faster that way.
When you delete your account, your card subscription is canceled at once, and remaining checks, packs and any remaining crypto period are lost. Deleting an account is not a refund request; refunds are handled only under the Refund policy.
14. Liability
The Service is provided as is. To the extent the law allows, we are not liable for lost profits, for names you could not claim or for indirect damage. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the mandatory law of your country.
15. Changes to these terms
We may update these terms. We tell you about important changes by email or with a notice on the site before they take effect. If you keep using the Service after that, the new terms apply. If you do not agree, you can delete your account.
16. Law and language
These terms are governed by the laws of [country]. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.
The English version of these terms is the binding one. Versions in other languages are translations for your convenience.
